    ARE Outdoor Workmanship Warranty

    At ARE Outdoor, we take pride in delivering high-quality outdoor construction projects built to last. We stand behind our workmanship and are committed to installing every project in accordance with manufacturer specifications, industry best practices, and accepted construction standards.

    To demonstrate our commitment to quality, ARE Outdoor provides the following Limited Workmanship Warranty.

    10-Year Limited Workmanship Warranty

    ARE Outdoor warrants its workmanship for a period of ten (10) years from the date of substantial project completion.

    If a defect is determined to be the direct result of improper installation performed by ARE Outdoor, we will repair or replace the defective workmanship at no cost to the original purchaser, subject to the terms, conditions, and exclusions contained in this warranty.

    This warranty applies only to defects caused by ARE Outdoor's workmanship and does not cover defects in materials or conditions outside of our control.

    Manufacturer Material Warranty

    All products and materials installed by ARE Outdoor are covered solely by the manufacturer's warranty, if applicable.

    Manufacturer warranties vary by product and supplier and may include, but are not limited to:

    • Retaining wall block systems
    • Pavers
    • Drainage pipe and fittings
    • Catch basins
    • Channel drains
    • Geotextile fabric
    • Landscape lighting fixtures
    • Irrigation components
    • Adhesives
    • Sealers
    • Other installed products

    ARE Outdoor will assist customers in coordinating warranty claims with the manufacturer whenever possible; however, warranty approval, replacement materials, and material coverage are solely the responsibility of the manufacturer.

    Unless otherwise covered by the manufacturer or required due to defective installation by ARE Outdoor, labor associated with replacing defective materials is not included under this warranty.

    Warranty Coverage Includes

    The ARE Outdoor Workmanship Warranty may include repairs resulting from:

    • Improper installation methods
    • Improper grading performed by ARE Outdoor
    • Improper drainage system installation
    • Improper retaining wall construction
    • Improper paver installation
    • Improper landscape lighting installation
    • Improper irrigation installation
    • Improper hardscape installation
    • Loose, shifting, or failed workmanship caused by installation defects

    Warranty Does Not Cover

    This warranty does not cover failures or damage resulting from:

    • Normal wear and tear
    • Natural soil settlement
    • Soil movement
    • Expansive soils
    • Erosion beyond the contracted work area
    • Flooding
    • Extreme weather events
    • Extraordinary or historic rainfall
    • Earthquakes
    • Sinkholes
    • Utility failures
    • Improper maintenance
    • Abuse or misuse
    • Vehicle traffic where not intended
    • Tree root intrusion
    • Animal or insect damage
    • Chemical damage
    • Freeze-thaw cycles beyond normal design tolerances
    • Color fading
    • Efflorescence
    • Damage caused by other contractors or third parties
    • Modifications or repairs performed by anyone other than ARE Outdoor
    • Existing site conditions not included within the contracted scope of work
    • Conditions concealed below grade that could not reasonably be discovered during installation
    • Acts of God

    Drainage System Performance Disclaimer

    ARE Outdoor designs and installs drainage systems using accepted engineering principles, manufacturer recommendations, and industry best practices based on the site conditions observed at the time of installation.

    Our goal is to significantly improve drainage performance and reduce standing water; however, no drainage system can guarantee that all water will be eliminated under every rainfall event or site condition.

    Drainage performance may be affected by factors beyond the control of ARE Outdoor, including but not limited to:

    • Exceptional or historic rainfall events exceeding the design capacity of the installed system.
    • Saturated soil conditions during prolonged wet weather.
    • Changes in site grading or landscaping after project completion.
    • New construction or grading changes on neighboring properties.
    • Additional roofs, driveways, patios, pools, sidewalks, or other impervious surfaces added after installation.
    • Blocked, damaged, frozen, or obstructed drainage outlets.
    • Failure to perform routine maintenance.
    • Leaves, mulch, sediment, or debris clogging catch basins, channel drains, grates, cleanouts, or discharge points.
    • Soil settlement, erosion, or ground movement occurring after installation.
    • Utility work or excavation performed by others.
    • Damage caused by vehicles or heavy equipment.
    • Tree roots or vegetation affecting underground drainage components.
    • Municipal storm sewer backups.
    • Inadequate public drainage infrastructure.
    • Groundwater conditions or underground springs.
    • Underground conditions that were unknown or could not reasonably be identified during the initial site inspection.

    The ARE Outdoor 10-Year Limited Workmanship Warranty covers only defects resulting from improper installation performed by ARE Outdoor.

    It does not guarantee a completely dry property under all weather conditions, nor does it guarantee that standing water will never occur during unusually heavy rainfall, prolonged storms, saturated soil conditions, or weather events that exceed the intended design capacity of the installed drainage system.

    If a drainage concern arises during the warranty period, ARE Outdoor will inspect the installation to determine whether the issue is the result of defective workmanship.

    If the issue is covered under this warranty, ARE Outdoor will repair the defective workmanship at no cost to the original purchaser.

    If the issue is caused by factors outside the scope of this warranty, ARE Outdoor will provide recommendations and, if requested, a proposal for any additional work needed.

    Customer Responsibilities

    To maintain warranty coverage, the customer agrees to:

    • Properly maintain the completed project.
    • Follow all maintenance recommendations provided by ARE Outdoor and applicable manufacturers.
    • Keep all drainage system components free of debris, leaves, mulch, sediment, vegetation, and other obstructions.
    • Maintain all catch basins, channel drains, grates, cleanouts, and discharge points.
    • Promptly notify ARE Outdoor of any suspected warranty issue.
    • Take reasonable steps to prevent additional damage after discovering a problem.
    • Provide ARE Outdoor reasonable access to inspect and perform warranty repairs.

    Failure to perform reasonable maintenance may void warranty coverage for any resulting damage or performance issues.

    Warranty Claims

    To submit a warranty claim, please provide:

    • Customer name
    • Property address
    • Project completion date
    • Description of the issue
    • Photographs of the affected area (if available)

    ARE Outdoor will inspect the reported condition and determine whether it qualifies for coverage under this Limited Warranty.

    If the claim is approved, repairs will be scheduled within a reasonable time based upon weather conditions, seasonal workload, material availability, and site accessibility.

    Transferability

    This warranty is provided solely to the original purchaser of the project and is not transferable unless approved in writing by ARE Outdoor.

    Limitation of Liability

    This Limited Warranty is limited exclusively to the repair or replacement of defective workmanship performed by ARE Outdoor.

    Under no circumstances shall ARE Outdoor be liable for any incidental, indirect, consequential, special, or punitive damages, including but not limited to:

    • Loss of use of the property
    • Loss of property value
    • Damage to landscaping outside the contracted work area
    • Loss of business
    • Temporary relocation costs
    • Water damage not caused by defective workmanship
    • Mold or mildew
    • Attorney fees
    • Any other consequential losses, except where prohibited by applicable law.

    ARE Outdoor's maximum liability under this warranty shall not exceed the original contract price paid for the specific portion of the work determined to be defective.

    Entire Warranty

    This Limited Warranty represents the complete workmanship warranty provided by ARE Outdoor and supersedes all prior verbal statements, representations, or understandings.

    No employee, salesperson, subcontractor, or representative of ARE Outdoor is authorized to modify this warranty unless such modification is made in writing and signed by an authorized officer of ARE Outdoor.

    Governing Law

    This Limited Warranty shall be governed by and interpreted in accordance with the laws of the Commonwealth of Kentucky.
